Acceptance of Terms
By downloading, installing, or using the Audiobooks - MP3 & M4B Player app ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.
Description of Service
The App provides the following features:
- Audiobook playback for MP3 and M4B files
- Library management and playback progress tracking
- On-device text-to-speech conversion of EPUB files using Apple's AVSpeechSynthesizer (free)
- Cloud-based text-to-speech conversion of EPUB files (requires in-app purchase)
In-App Purchases
- The App offers consumable in-app purchases for cloud text-to-speech conversion, tiered by book length.
- All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Refunds are handled by Apple per their refund policy.
- Cloud processing tokens issued upon purchase expire after 30 days.
User Content
- You may only use the text-to-speech features to convert content that you own or have the legal right to convert. You must not use the App to convert copyrighted content that you do not have permission to use.
- The App does not provide, host, or distribute book content.
- You are solely responsible for ensuring you have the necessary rights to any content you add to the App.
Cloud Processing Terms
When you use the cloud text-to-speech service:
- Text content from your EPUB files is transmitted to our server for processing.
- We do not store any user data on our servers. Text is processed in memory and discarded immediately after audio generation.
- Generated audio files are returned to your device and are not retained on the server.
- The service is provided "as is" without warranty regarding audio quality, accuracy, or availability.
- We reserve the right to modify, suspend, or discontinue the cloud processing service at any time.
Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the App or its server components
- Abuse, overload, or interfere with the cloud text-to-speech service
- Use the App to convert copyrighted content without permission from the rights holder
- Redistribute, sell, or sublicense audio generated through the cloud service
Internet Connectivity
Cloud text-to-speech conversion requires an active internet connection. You are responsible for any data charges incurred. Core audiobook playback and on-device text-to-speech features work offline.
Limitation of Liability
To the maximum extent permitted by applicable law, the developer shall not be liable for interruptions or unavailability of the cloud service, loss of data or playback progress, quality of generated audio, or any indirect, incidental, special, or consequential damages arising from use of the App.
Intellectual Property
The App and its original content, features, and functionality are owned by Pavlo Klymenko. Audio files generated through the cloud text-to-speech service are for your personal use only.
App Updates and Termination
We may release updates to the App and may discontinue any features at any time. Audio files previously generated and saved to your device remain accessible regardless of service changes. We reserve the right to terminate your access to the cloud service if these terms are violated.
Changes to These Terms
We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised terms.
